Energy, Municipal, Environmental Law and Litigation:

  • Continuously advise numerous clients on wholesale power supply strategy, power supply products, natural gas supply strategy and hedging strategy.
  • Negotiate and document wholesale power supply purchase transactions for approximately forty public power clients.  These transactions include fixed price and heat rate / fuel indexed purchases of power, purchases of unit contingent power, system power, must take and capacity.
  • Advise clients on ISO New England rules and requirements.
  • Negotiate and document natural gas purchase transactions for local distribution companies and large retail purchasers.
  • Advise clients on substation and infrastructure projects.
  • Negotiate and document interconnection agreements.
  • Advise municipal and other public power clients on general municipal, public power and general business issues.  This includes researching legal issues, drafting legal opinions and meeting with and advising key personnel and governing boards.
  • Assist municipal utilities with providing internet service.  This involves the development and drafting of service provider contracts and the creation and updating of terms of use and other terms and conditions.
  • Develop and negotiate project contracts for public power plant projects, including agreements for the purchase and sale of unit contingent power and capacity, governing structure, development and construction.
  • Advise public developers of power plants on municipal zoning requirements, environmental permitting, bidding requirements and siting requirements.
  • Represent clients in Massachusetts State Courts, Massachusetts Federal District Court, First Circuit Court of Appeals and before regulatory agencies including the Massachusetts Energy Facilities Siting Board, the Massachusetts Department of Public Utilities and the New Hampshire Public Utilities Commission.
