Maxwell Feit represents clients in bankruptcy, insolvency and creditors’ rights matters as well as commercial litigation. Max represents various stakeholders in restructuring and liquidation transactions in and outside of bankruptcy, including debtors, secured creditors, vendors, creditors’ committees, insiders and other parties in interest. His bankruptcy experience includes guiding corporate debtors into and out of Chapter 11 reorganizations, securing maximum recoveries for creditors through Chapter 11 plan negotiations and denial of discharge litigation, and investigating inter-company transfers on behalf of debtors and creditors’ committees.
His litigation experience includes prosecuting and defending fraudulent transfer and preference claims, shareholder litigation, corporate management disputes, fiduciary duty disputes, administrative appeals and land use litigation. Max has conducted internal investigations for corporate clients faced with potential employee misconduct and has represented investors who were the victims of such misconduct. Max has appeared in state and federal courts in Massachusetts, New York, Delaware, and Missouri.
Max served as a law clerk to the Honorable Melvin S. Hoffman of the United States Bankruptcy Court for the District of Massachusetts from 2019 to 2020. While at the Court, Max drafted opinions and research memoranda for use in individual and commercial bankruptcy cases and related adversary proceedings. Max analyzed pleadings and reviewed testimony and documentary evidence to assist the Court with adjudication of fact-intensive litigation and complex statutory interpretation.
