John Egan, a partner in the firm’s Litigation Department was recently quoted in Massachusetts Lawyers Weekly regarding a failure-to-warn claim against a medical device maker.
The article questions whether or not the manufacturer can be held liable for failing to warn a purchasing hospital of the risks of using its technology to treat a patient.
“Holding the manufacturer to a duty to warn the hospital is effectively meaningless unless there is a formal protocol in place for communicating that warning to the physician who is ultimately responsible for informing the patient,” Egan said.
