MCLE Description:

As mobility increases and families relocate across state lines, determining where to file for divorce can become a critical strategic decision. This session explores the jurisdictional requirements for divorce in Massachusetts and how they compare with those of other states, including residency rules, waiting periods, and high-level differences in divorce law that may impact case outcomes.

Faculty take a practical look at what to consider when choosing the most favorable jurisdiction amongst multiple available options. The program also addresses potential conflicts of law, judicial discretion in jurisdictional disputes, and best practices for advising clients who are contemplating or preparing to file in a multi-state context.

Agenda Highlights:

  • Strategic Considerations
  • Jurisdictional Requirements
  • Comparing State Laws on Property Division, Alimony, Child Custody, and Parenting Time
