Modernizing Estate Plan for Strategic Wealth Management and Next-Generation Security

Redesigned decade-old estate plan for a couple whose family and financial circumstances had significantly evolved. Updated and restructured key documents to maximize asset protection and align with clients’ goals of protecting their wealth for their now adult children and future generations. Established an irrevocable life insurance trust (ILIT) to efficiently manage life insurance benefits, minimize tax liability and further support long-term financial strategy.

Foundational Estate Planning for a Young, Expanding Family

Designed and executed an estate plan for a young married couple who had recently welcomed their second child and purchased their first home. The plan provided a legal framework to protect their growing family and included guardianship designations, financial directives, and trust provisions to ensure their children’s well-being and long-term security.

Navigating Long-Term Care Crisis Planning After Sudden Disability

Represented a client unexpectedly seeking MassHealth coverage for her sixty-five (65) year old husband, after a tragic accident left him hospitalized, ventilator-dependent and requiring long-term care. Prepared and submitted the MassHealth application. Successfully argued eligibility appeal to ensure that previous payments for support of young adult children were not considered gifts for which a penalty should be assessed, and that the client be allowed to keep all of the couples’ assets, including their family business as it was essential for her self-support.

Protecting Family Autonomy in the Face of Nursing Home Conservatorship Action

Advised daughter after a nursing home sought to be appointed as her mother’s conservator due to an unpaid private pay bill of over $500,000 and a previously denied MassHealth application. Successfully intervened to have the facility’s petition dismissed by affirming the daughter’s authority under a valid power of attorney. Assisted with the administration of recently deceased father’s estate, including the funding of a testamentary trust for her mother. Guided the daughter through the MassHealth application, ultimately securing benefits for her mother and preserving the family’s control over her care and finances.

Guardianship to Support Mental Health Treatment and Education Advocacy

Represented the parents of a soon-to-be eighteen-year-old who was hospitalized and facing severe mental health challenges, including self-harm. Successfully obtained an emergency temporary guardianship appointment, allowing the parents to authorize critical antipsychotic treatment and coordinate with inpatient care facility to ensure a safe return home and successful reintegration into society. Empowered guardians to negotiate with child’s school district, resulting in a settlement agreement that addressed child’s ongoing educational needs.

Emergency Conservatorship and Trust Creation to Preserve Public Benefits and Housing

Petitioned the court for the emergency appointment of a conservator to create and fund a supplemental needs trust for a beneficiary with severe mental health conditions, ensuring continued MassHealth eligibility as she approached her 65th birthday. Successfully expedited the court hearing, secured approval for the conservatorship, and established the trust in time to respond to preserve the beneficiary’s MassHealth’s eligibility and housing.

Guiding a Family Through Estate Administration After a Parent’s Death
