Rubin and Rudman LLP (“R&R”, “we” or “us” herein) respects your right to privacy. This Privacy Policy (the “Policy) is intended to disclose how R&R collects, uses, shares and discloses personal information about users of our sites and explains the choices and rights individuals have regarding their personal information.  This Policy applies to all individuals who access our website (www.rubinrudman.com), our social media platforms and any other communication services provided on or through the internet (collectively our “Site(s)”), as well as any data received from clients in relation to our legal services (the “Services”).

 

Please read this Policy carefully.  By accessing or using our Site, you agree to this Privacy Policy.  If you do not agree with our policies and practice, your choice is not to use our Site.

To the extent required by applicable data protection laws, we will obtain your consent to any material Policy changes.

Information We May Collect

We collect information directly from individuals online, as well as automatically through the use of our Sites.  Throughout this policy, we refer to “personal information” to describe any information that identifies you or makes you identifiable. Information that has been anonymized so that it does not identify a specific individual is not considered personal information.

We may collect and retain the following information when providing Services:

Information You Provide Voluntarily

We may collect personal information about you such as your name, address, telephone number, fax number, email address, company affiliation, etc. This is information that you provide to us directly and voluntarily.  For example, personal information may be collected when you register to attend an event that we are hosting or sponsoring, when you sign up for our mailing lists, when you request to receive a newsletter, alert, blog or other marketing-related communication, when you submit an application for employment, or when you retain us for legal services.  With regard to career information, the information you provide may also include qualifications and employment history.  We only collect the personal information we need to allow us to respond your requests and provide you with the particular service you are seeking.

Please note:  Unless specifically requested, we request that you not send us any confidential or sensitive information such as social security numbers or other national ID numbers, credit card numbers, health insurance numbers, or license numbers.

 

Information We Collect Automatically via Technology

As you navigate through our site, we may use automatic data collection technologies to collect certain information about your visit including the following:

 

  • The Site may use “cookies” to help the user personalize their online experience. A cookie is small text file created by a website that is stored in the user’s computer either temporarily for that session only or permanently on the hard disk. Cookies provide a way for the website to recognize you and keep track of your preferences. We may use both persistent and session cookies.  Persistent cookies remain on your commuter after you close your session and until you delete them, while session cookies expire when you close your browser.

 

We use cookies to display information more effectively, to store on a user’s computer or device information about the user’s preference and settings, collect statistical information about the use of our Service to improve our design and functionality, and for security purposes.

 

  • Performance and Log Data. Our servers automatically record information created by your use of our Services. This information can include the following:  your IP address, traffic data, location data, logs and other communication data as well as the resources that you access and use on our site. Information about your computer, internet connection, browser type, domain names and access times.  For example, when we send you an e-mail, we may collect information pertaining to the nature of the e-mail, whether you opened our e-mail, when you opened our email, the action you took – whether you opened it, deleted it or forwarded it – and your name and contact information.
  • Device Information. We may collect information about devices you use to access the Services and how you use the Services, such as your Internet Protocol (“IP”) address and which websites, if any, that you visited before accessing our Services.
  • Do-Not-Track Signals. Our Site does not currently respond to web browser “do not track” signals or other mechanisms that may allow you to opt out of the collection of information across networks of websites and online services as there is no standard for how online services should respond to such signals. As standards develop, we may develop policies for responding to such signals that we will describe in this Privacy Policy.
How We Use and Share Your Information
  • Provide Support and Services to You. We process your personal information to inform you about our Services if you are or become a client of the firm. To update you on law firm and industry developments that may be of interest to you, communicate with you about relevant events and firm-wide initiatives and generally to fulfill your orders and requests, process payments, etc.
  • Respond to Your Requests. We process your personal information when you contact us, with questions, and requests for information, concerns, disputes, or other issues. Without your personal information, we cannot respond to you or ensure your continued use of the Services.
  • By personalizing the services, we can tailor our content including language preferences, time zones, etc. to offer you a better user experience.  Without this personal information, you may not be able to access or personalize part or all of our Services.
  • Marketing and Business Development Activities. To share information about Services with you, we process your contact information in order to send you marketing communications including, newsletters, client alerts, and other information that we think may be of interest to you and keeps you informed about our products and Services. Please note:  You can opt-out of our marketing activities at any time by clicking on the unsubscribe link in all electronic marketing communications.
  • For Potential Employment. We process your personal information when you seek employment or inquire about career opportunities with us to evaluate you as a potential candidate for the position. Without this information, we cannot adequately evaluate your qualifications for employment.
  • Enforce Our Terms or Agreements. We process your personal information to observe, investigate, prevent and diminish any perceived or actual illicit or illegal activities related to our Services and where we believe necessary to investigate, prevent, or take necessary action regarding other illegal activities including suspected fraud and incidents involving potential threats to the safety or legal rights of any person or third party, or violations of our Terms of the Use of this Policy.  We cannot perform our Services in accordance with our terms, agreements or policies without processing your personal information for such purposes.
  • To Ensure the Security of the Services. We are committed to ensuring your safety and continued use of our Services. To do so, we process your personal information to: combat spam, malware, malicious activities or security risks; to improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not access your account with us. We cannot ensure the security of our Services if we do not process your personal information for security purposes.
  • Analytics, Research and Development Purposes. To better understand how users access and use the Sites, and for research and development purposes, such as to evaluate and improve our services and business operations and to develop new services and features. We take additional security measures when processing your personal information for such purposes, by de-identifying or pseudonymizing your information, limiting access to personnel that may conduct research and development, and applying other technical, physical, and administrative security measures.

 

If, in the future, we use your personal information in any way that is not described in this Privacy Policy, we will disclose this to you. At that time, you can choose not to allow us to use your personal information for any purpose that is incompatible with the purposes for which we originally collected it or subsequently obtained your consent. If you choose to limit the ways we can use your personal information, some or all of the Services may not be available to you.

Sharing and Disclosure of Personal Information

R&R does not rent, sell, exchange, transfer or give your personal information to any other individual, company or third party for their marketing purposes or any other reason except as outlined here:

 

  • Our IT and Security Services Providers. We share information with our IT service providers, suppliers, subcontractors, and similar third parties who provide IT or Security services to us, or act on our behalf so that they can assist us with the maintenance of our Service. Our contracts with these IT and Security service providers prohibit them from using or sharing with others, for purposes other than as directed by us, the information that we provide to them, or that they collect directly from our users.
  • Firm Reorganization, Merger, etc. We may transfer information to a third party in case of the reorganization, merger, assignment, transfer or other disposition of all or any portion of our business, including related to due diligence conducted prior to such event where permitted by law.  We reserve the right, as part of this transaction, to transfer or assign information we have collected from users of the Services to these third parties. Except as otherwise provided by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to policies that are consistent with the policies described in this Privacy Notice. However, any information that a user submits or that is collected after that transfer may be subject to a new privacy policy adopted by the successor entity.
  • Legally Required. We may use, share, or disclose information about users if we are required to do so by law (e.g. to law enforcement officials, the courts, or others in response to a subpoena or court order).
  • With Consent. We will disclose your information to a person if you have given us your consent to disclose to.
Access to Your Information

If you would like to review the personal information we have collected about you via the Sites, or request that we update or delete it, please contact us at computerSupport@rubinrudman.com.  For your protection, we may need to verify your identity before implementing your request. We will try to implement your request as soon as reasonably possible.

Please be clear when making your request and include detailed information about what information you would like to have changed, whether you would like to have your personal information removed from our database, or set other limitations for our use of your personal information.

Please note that we reserve the right to refuse to act on a request that is baseless or excessive.  We may also require a fee to cover the administrative costs for providing the information or taking the action requested.

How We Keep Your Information Secure

We employ security measures to prevent unauthorized access to information that we collect online.  We strive to use all realistic technical, organizational, and administrative methods available to us to protect user information within our organization against the unauthorized or unlawful access or processing, and against accidental loss, destruction, or damage.

However, even though R&R makes reasonable efforts to protect the information in its care, we cannot guarantee the security of your personal information as no data storage or transmission over the Internet and no security system is fully secure.

Retention

We retain information about users for as long as necessary to perform the activities described in this Privacy Policy, or where we have an ongoing legitimate business reason to do so. When our legitimate interests for retaining your personal information cease to exist, we will use our best efforts either to delete or to anonymize your information so that it can no longer be attributed to a particular individual.

Children’s Information

In order to respect the privacy of minors, R&R does not knowingly collect, maintain or process any personal information from children under 16. If we become aware that an individual under 16 is submitting information, we will delete the information as soon as possible from our database.

Special Notice to European Residents

Under EU data protection laws, individuals may have certain data protection rights which may be subject to limitations and or restrictions including the following:

  • Right of access. You have the right to obtain from us how and where information concerning you is processed, and, when that is the case, you have the right to request and get access to that personal data.
  • Right to rectification. You have the right to obtain from us the rectification of inaccurate personal data. In addition to this, you have the right to provide information in order to complete potentially incomplete personal data.
  • Right to erasure (“Right to be forgotten”). In certain situations, you have the right to obtain from us the erasure of your personal data, and we have the obligation to delete it without undue delay.
  • Right to restriction of processing. In certain situations, you have the right to impose on us certain restrictions on processing.
  • Right to data portability. You have the right to receive from us in a structured, commonly used and machine-readable format your personal data and you have the right to transmit that personal data to another.
  • Right to object. In certain situations, you have the right to object to the processing of your personal data, including through profiling. You have the right to object to further processing of your personal data insofar as such data have been collected for direct marketing purposes.
  • Right not to be subject to automated individual decision-making. You have the right not to be subject to a decision based solely on automated processing, including profiling.
  • Right to file complaints. You have the right to file complaints with the applicable data protection authority regarding our processing of your personal data.
  • Right to compensation of damages. In case we breach applicable law on processing your personal data, you have the right to claim damages from us for any damages such breach may cause you.
Special Notice to California Residents

Under California Civil Code Section 1798.83 California residents are entitled to request information regarding our disclosure of certain categories of Personal Information to third parties for those third parties’ direct marketing purposes. To make such a request, please contact us at computersupport@rubinrudman.com. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the e-mail or mailing address specified in this Section.
