Her work centers on Medicaid eligibility and appeals, special needs and estate planning, probate and trust administration, and guardianship and conservatorship matters.

She has extensive experience preparing and filing complex MassHealth long-term care applications and regularly represents clients in appeals when benefits are denied—often in high-stakes matters involving unsettled areas of law. Lisa has successfully advocated for clients before the Office of Medicaid Board of Hearings, as well as in Massachusetts trial and appellate courts, including the Supreme Judicial Court.

She also represents fiduciaries and beneficiaries in disputes involving MassHealth estate recovery and has been retained as an expert witness in trust litigation and Medicaid eligibility matters. Clients turn to Lisa for guidance in preparing key planning documents such as powers of attorney, health care proxies, wills, and trusts designed to preserve eligibility for public benefits and provide long-term financial security, particularly for individuals with disabilities and special needs.

Precedent-Setting Win Before the Massachusetts Supreme Judicial Court in Trust Planning Case

Successfully represented the plaintiff in Fournier v. Sudders, 488 Mass. 43 (2021), where the Supreme Judicial Court held that a retained limited power of appointment to charities in an irrevocable trust does not render the trust countable for Medicaid eligibility purposes.

Landmark Ruling on Nominee Trusts and Medicaid Eligibility

Prevailed in Guilfoil v. Sudders, 486 Mass. 788 (2021), in which the Massachusetts Supreme Judicial Court ruled that a nominee trust was not a countable asset in the context of Medicaid long-term care eligibility.

SJC Denial of Certiorari Leaves Trust Eligibility Precedent Intact

Represented the plaintiff in Dermody v. Executive Office of Health and Human Services, 491 Mass. 223 (2023), a case addressing the treatment of irrevocable trusts in Medicaid eligibility. The petition for certiorari was denied, leaving the Massachusetts decision as binding precedent.

Established Critical Protection for Homes Held in Irrevocable Trusts

Successfully argued before the Massachusetts Supreme Judicial Court in Daley v. Executive Office of Health and Human Services & Nadeau v. Director of the Office of Medicaid, 477 Mass. 188 (2017), securing a ruling that a residence held in an irrevocable trust is not countable for Medicaid eligibility when the grantor retains a life estate or right of occupancy.

Appellate Victory Clarified Treatment of Annuities in Irrevocable Trusts

Won reversal in Heyn v. Director of the Office of Medicaid, 89 Mass. App. Ct. 312 (2016), where the Appeals Court held that the mere authority of a trustee to purchase an annuity or allocate trust funds did not render the assets countable for Medicaid eligibility.
