Tyler brings a profound understanding of environmental systems and regulatory frameworks to his work advising clients on environmental, land use, and real estate matters throughout Massachusetts.

Before attending law school, Tyler worked in hazardous waste remediation at the New Bedford Harbor Superfund Site for several years. That hands-on experience ignited a lasting interest in the intersection of environmental science, law, and policy, which continues to propel his practice today.

Tyler represents developers, corporations, and homeowners in navigating the complex regulatory terrain of project permitting, waterfront development, and environmental enforcement. Many of his matters involve high-value properties on the Cape and Islands, where his guidance is especially valued for addressing evolving coastal resiliency regulations, floodplain standards, and stormwater management. He regularly appears before zoning boards, planning boards, conservation commissions, and state agencies and coordinates closely with environmental consultants, engineers, and other stakeholders to advance his clients’ goals.

His clients frequently face unexpected challenges—wetlands permitting delays, contamination concerns, or shifting regulatory interpretations. Tyler is known for helping clients chart a clear, pragmatic path forward that minimizes delay and disruption. Whether protecting long-term development plans for family-held property or managing enforcement defense strategies under statutes like the Massachusetts Wetlands Protection Act, MEPA, Chapter 91, or Chapter 21E, Tyler’s strategic thinking and commitment to creative problem-solving are at the core of his work.

In addition to his environmental and land use practice, Tyler maintains a diverse litigation docket, representing universities, businesses, insurers, and professionals in disputes involving product liability, toxic torts, construction defects, real estate conflicts, and personal injury claims. He regularly appears before the Massachusetts Superior Courts and the Land Court.
Clients and colleagues alike value Tyler for his ability to distill complex legal frameworks into practical solutions and his determination to help clients achieve their vision without sacrificing time, purpose, or peace of mind.

LEGAL SOLUTIONS

Zoning Appeal Dismissed Due to Lack of Standing

Successfully obtained dismissal of a G.L. c. 40A, § 17 appeal in Massachusetts Superior Court challenging a zoning enforcement decision related to a proposed subdivision development. The case was resolved on the grounds that the plaintiff lacked standing, thus avoiding the need for time-consuming and costly discovery.

Constitutional Claims Rejected in Waterfront Access Dispute

Successfully defended clients against claims that they interfered with neighbors’ constitutional rights to access waterfront property through alleged threats, intimidation, or coercion. Representation included successful defense of appeals before both the Massachusetts Appeals Court and the Supreme Judicial Court.

Coastal Redevelopment Approved Following Appeal

Negotiated favorable terms of an Order of Conditions approving the raze and rebuild of a residence located in a coastal floodplain, following a successful appeal of the conservation commission’s project denial.

Scrap Metal Facility Permit Secured After Permit Denial and Settlement

Successfully argued that a local selectboard improperly denied a permit application to operate a scrap metal processing facility. On remand, negotiated settlement terms that resulted in the issuance of the permit, enabling the client to proceed with operations.

Adverse Possession Claims Settled to Preserve Lot Value

Negotiated a successful settlement of adverse possession claims that threatened the developability of a residential lot, thereby preserving the property’s full value and future use potential.

Waterfront Enforcement Order Rescinded

Secured the rescission of a conservation commission enforcement order that sought the removal of pressure-treated pilings supporting a multi-million-dollar waterfront home, eliminating costly and unnecessary remediation measures.

Wetlands Approval Defended in Precedent-Setting Case

Successfully defended the approval of two residential apartment buildings, associated parking, and infrastructure under the Massachusetts Wetlands Protection Act and associated regulations. The matter resulted in a precedent-setting Final Decision by the Office of Appeals and Dispute Resolution, affirming the appropriate scope of evidence for delineating mean annual highwater levels in low-gradient, meandering river environments.
