Fiduciary Litigation Associate
We are seeking an associate with four (4) to six (6) years of experience to join our highly regarded Fiduciary Litigation team, which is widely recognized for guiding clients through complex disputes involving trusts, estates, fiduciaries, guardianships, and conservatorships. The group represents beneficiaries, fiduciaries (including trustees, personal representatives, powers of attorney and health care proxies), and family members in matters such as will contests, trustee removal actions, breach of fiduciary duty claims, and contested guardianship and conservatorship proceedings.
The ideal candidate will have experience in litigation matters involving trusts and estates, fiduciary litigation, probate, guardianship, or other complex civil litigation. Strong analytical, writing, and advocacy skills are essential, along with the ability to manage matters independently and communicate effectively with clients and courts. The role requires sound judgment, professionalism, and the ability to navigate sensitive family and financial dynamics with discretion and empathy.
Responsibilities
- Manage a docket of contested fiduciary matters, serving as lead on motion practice, deposition preparation, courtroom hearings, and client strategy meetings.
- Draft pleadings, motions, briefs, affidavits, petitions, and related litigation documents.
- Oversee discovery, including drafting discovery requests and responses, managing document production, and preparing witnesses.
- Supervise paralegals and coordinate with administrative staff to ensure timely and accurate filings.
- Engage directly with clients, trustees, and fiduciaries to develop case strategies and handle hearings.
- Collaborate with colleagues in Trusts & Estates, Tax, Corporate, and Family Law to address intersecting issues in fiduciary disputes.
- Conduct legal research on fiduciary, probate, trust, guardianship, and conservatorship law, and prepare internal memoranda summarizing findings.
- Monitor evolving case law and advise the team on developments relevant to fiduciary litigation.
- Participate in depositions, assist with discovery management, and support trial preparation and strategy.
Qualifications
- JD from an accredited law school; admission and good standing with the Massachusetts Bar
- 4-6 years of experience in fiduciary litigation at a respected law firm (regional, national, or boutique)
- Excellent research, writing, and oral advocacy skills
- Ability to manage multiple matters proactively and independently within a team-based setting
Compensation
The firm’s expected salary range for this position is $160,000-$190,000. Actual salary will be determined based on education, experience, internal equity and other job-related factors, consistent with applicable law.
